Terms of Service

AI API Harbor provides a unified API for AI image and video generation models supplied by third party providers, together with a shared prepaid credit balance. The service is currently pre launch: the website collects a waitlist, no accounts exist, no API keys are issued and no payment is taken. Sections about credits, billing and API use apply from the moment those features become available to you.

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter a binding contract. If you use the service for an organisation, you confirm you are authorised to bind that organisation.

• Do not use the service to generate, distribute or store unlawful content, including child sexual abuse material, non consensual intimate imagery, or content that infringes another party's intellectual property.
• Do not create deceptive deepfakes of real people, forged identity or official documents, or content designed to defraud, harass or defame.
• Do not attempt to bypass provider safety systems, rate limits, quotas or usage controls, and do not resell raw model access in a way that violates the underlying provider terms.
• Do not probe, scan, overload or reverse engineer the service, or use it to build a directly competing aggregation product from our infrastructure.
• Do not submit personal data of others as prompt input where you have no lawful basis to do so.

We may suspend or terminate access for a breach of this section, and we may cooperate with lawful requests from authorities.

Generations are executed by third party model providers. Your use is also subject to the applicable provider policies, including their content and usage rules, and those policies may change without notice to us. A provider may deprecate, restrict or price change a model at any time, and we may have to remove or replace that model in response.

AI API Harbor is an independent platform. We are not affiliated with, endorsed by, or sponsored by OpenAI, Google, or any other model provider. All product names, logos and trademarks belong to their respective owners and are used only to describe the models reachable through our API.

• Credits are a prepaid entitlement to request generations. They are not money, not a deposit, not a stored value instrument and not redeemable for cash.
• Credits are consumed when a generation request is accepted and processed, including where the model returns a result you did not want.
• We will publish credit costs per model before launch and give notice before any increase takes effect for existing balances.
• Credits are non transferable between accounts unless we state otherwise in writing.

You keep whatever rights you hold in the prompts and files you submit. As between you and us, you own the outputs you generate to the extent permitted by law and by the applicable provider terms. You grant us a limited licence to process your inputs and outputs only to operate the service, including transmitting them to the provider you selected. We do not use your prompts or outputs to train models.

AI generated output may not be copyrightable in some jurisdictions and may resemble existing work. You are responsible for reviewing outputs before you publish or commercialise them.

We aim for high availability with failover between providers where possible, but we do not currently offer a contractual uptime guarantee. The service does not provide bulk generation pipelines, batch orchestration or background job management on your behalf.

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non infringement, and we make no warranty about the accuracy, legality or suitability of any model output.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, goodwill or data. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the three months immediately before the event giving rise to the claim, or ten United States dollars if you have paid nothing.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, or the mandatory statutory rights of consumers in the European Union, the United Kingdom, India or elsewhere.

You agree to indemnify us against third party claims arising from your use of the service in breach of these terms or in breach of applicable law, including claims about content you generated or published.

We may update these terms. Material changes will be posted here with an updated date and, where they affect paying customers, notified by email at least 14 days before they take effect. You may stop using the service at any time. We may suspend or terminate access for breach, legal requirement, or if we discontinue the service, in which case we will refund any unused prepaid credits.

These terms are governed by the laws of India, and the courts of Indore, Madhya Pradesh have exclusive jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of your country of residence or of your right to bring proceedings there.
